User Provided Information:

You provide certain personally identifiable information (such as your name, email address, credit card, and profile photo) to FANANGEL when choosing to participate in various activities on the Service. This includes registering for an account, participating in pledges, uploading pictures, posting comments, and donating to a current fundraiser.

Cookies Information: When you visit the FANANGEL.com website, we may send one or more cookies (small files) to your device, which may enable us to uniquely identify your browser. FANANGEL uses both session cookies and persistent cookies. A persistent cookie remains after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the site. Persistent cookies can be removed by following your web browser help file directions. Session cookies are temporary and typically disappear after you close your browser. You may be able to reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the FANANGEL.com website may not function properly if the ability to accept cookies is disabled.

Log File Information: When you use FANANGEL, our servers may automatically record certain information that your device sends whenever you visit any website and use certain apps. These server logs may include information such as your web or app request, Internet Protocol ("IP") address, browser type, browser language, referring/exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser.

Clear GIFs Information: When you use FANANGEL, we may employ technology such as "clear GIFs" (a.k.a. Web Beacons) which are used to track the online usage patterns of our Users. In addition, we may also use clear GIFs in HTML-based emails sent to our users to track which emails are opened by specific users.

The Way FANANGEL Uses This Information

We use your personal information to operate, maintain, and provide to you the features and functionality of FANANGEL, including but not limited to the following: (a) providing you our service; (b) processing and responding to inquiries; (c) alerting you to new Service features, special events, products and services, or certain third-party products or services in which we think you will be interested; and (d) enforcing the legal terms that govern your use of the Service.

We may use your information to contact you for non-marketing or administrative purposes (such as notifying you of major FANANGEL changes or for customer service purposes).

We use your information to improve the quality and design of FANANGEL and to create new features, promotions, functionality, and services, such as by storing, tracking, and analyzing User preferences and trends.

We also use cookies, clear gifs, and log file information for purposes such as (a) remembering information so that you will not have to re-enter it during your visit or the next time you visit FANANGEL; (b) providing custom, personalized content and information; (c) monitoring the effectiveness of our fundraising campaigns; (d) monitoring aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) tracking your entries, submissions, and status in promotions.

We may anonymize or aggregate your information for business purposes, including for reporting and research. Anonymous and/or aggregated data does not identify you, and we may use and disclose such information without limitation.

When FANANGEL Discloses Information

Our subsidiaries, affiliated companies, agents, or other businesses or persons may have authorized access to your information (such as name or email address) for the purpose of processing such information on our behalf, including by using the information to make improvements to the services they provide. We may disclose personally identifiable information in response to your requests for customer service. As agreed in our Terms of Use, we may use personal information about you (such as your name and photo) in connection with marketing and publicity purposes. We will publish a profile page that includes your display name, and, if you uploaded one, your profile picture. When you participate in a fundraiser, we may publish your display name on the page. We share with the campaign administrator the names and emails of all users who pledged/donated to that campaign.  Moreover, we may share display names and emails with that campaign's beneficiary when requested by the campaign administrator.

Names and emails entered into FANANGEL are never sold, leased or given to third parties except as described above. Moreover, emails entered by participants that DO NOT donate or pledge to campaigns are not shared with the campaign administrators.

FANANGEL reserves the right to disclose personally identifiable information that FANANGEL believes, in good faith, is appropriate or necessary to enforce our Terms of Use, take precautions against liability or harm, to investigate and respond to third-party claims or allegations, to respond to a subpoena, legal order, or official request, to protect the security or integrity of our Service, and to protect the rights, property, or safety of FANANGEL, our users or others. Information also may be shared as described in the Merger, Sale or Bankruptcy section below.

Your Choices

You may, of course, decline to submit personally identifiable information through FANANGEL, in which case FANANGEL may not be able to provide certain services to you.

To protect your privacy and security, we reserve the right to take reasonable steps (such as requesting your password) to verify your identity before granting you profile access or making corrections. 1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide when you register for an account, make or receive a donation, create or manage a campaign, upload content, post comments, or otherwise contact us. The personal information we collect may include:

  • names and display names
  • email addresses
  • usernames and passwords
  • profile photos and images you upload
  • mailing address (when required for a campaign or receipt)
  • the content of comments and posts you submit

Payment information. When you make a donation, your payment card details are collected and processed directly by our payment processor, Stripe. We do not store full payment card numbers. We receive limited transaction information from Stripe, such as the donation amount, the card brand and last four digits, and the name and email associated with the payment, which we use to record and manage the donation.

All personal information you provide must be true, complete, and accurate, and you must notify us of any changes.

Information automatically collected

In Short: Some information, such as your IP address and browser and device characteristics, is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity but may include device and usage information such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, pages viewed and the order viewed, time spent on pages, and other technical information. This is primarily needed to maintain the security and operation of our Services and for internal analytics and reporting.

  • Log and Usage Data. Service-related, diagnostic, usage, and performance information our servers automatically collect, recorded in log files. This may include your IP address, device information, browser type, and information about your activity in the Services (such as date/time stamps, pages and files viewed, and actions taken).
  • Device Data. Information about the computer, phone, tablet, or other device you use to access the Services, which may include IP address, device identifiers, browser type, hardware model, internet service provider, operating system, and configuration information.

2. HOW DO WE PROCESS YOUR INFORMATION?

  • To process and manage donations and campaigns. We process your information to handle donations, pledges, refunds, payouts, and the operation of fundraising campaigns through the Services.
  • To respond to inquiries and offer support. We process your information to respond to your inquiries and resolve any issues with the Services.
  • To send administrative information, such as details about our products and services, changes to our terms and policies, and other similar information.
  • To enable user-to-user interactions, such as displaying donor and organizer activity on public campaign pages where applicable.
  • To request feedback about your use of our Services.
  • To improve the Services, including by storing, tracking, and analyzing usage, preferences, and trends in order to develop new features and improve design and performance.
  • To market and promote our Services. We may identify the schools, teams, and groups that use the Services as customers, and we may use fundraising campaign content and information that you have already made public through the Services, such as campaign titles and descriptions, team and group names, photos displayed on a public campaign page, the amount raised, and the number of supporters, to promote and market our Services. We do not use your private information or contact details (such as your email address) for this purpose. For clarity, we do not use any content from the FanAngel Connect Service or student data to market our Services; those are governed by the FanAngel Connect Privacy Policy and your school's data privacy agreement.
  • To comply with our legal obligations, respond to legal requests, and exercise, establish, or defend our legal rights.

3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in the specific situations described in this section and with the following parties.

  • Payment processor (Stripe). We share the information necessary to process your donation with Stripe. Stripe's handling of your information is governed by its own privacy policy.
  • Campaign organizers. When you pledge or donate to a campaign, we share your name and email with the administrator of that campaign so they can manage and acknowledge contributions. Email addresses of people who do not donate or pledge to a campaign are not shared with that campaign's administrator.
  • Campaign beneficiaries. When requested by the campaign administrator, we may share the display names and emails of donors with that campaign's beneficiary.
  • FanAngel Foundation. Where a donation is made to or through the FanAngel Foundation, we share the donor's name, email, and donation amount with the Foundation so it can issue the applicable tax receipt and acknowledge the gift.
  • Service providers. We share information with third-party vendors and service providers that perform services for us, pursuant to a written contract, such as hosting, analytics, and email delivery.
  • Legal and safety. We may disclose information where we believe in good faith it is appropriate or necessary to enforce our terms, respond to a subpoena or legal request, protect the security or integrity of our Services, or protect the rights, property, or safety of FanAngel, our users, or others.
  • Business transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

We do not sell the names or emails entered into the Services, and we do not lease or give them to third parties except as described in this Privacy Notice.

4. PUBLIC CAMPAIGN PAGES AND PROFILES

In Short: Some information you provide is published on public campaign pages.

FanAngel Fundraising is a public fundraising platform. Please note that any content you post, such as your display name, profile photo, and comments, is not treated as private and may be published on the Services. Specifically:

  • We may publish a profile page that includes your display name and, if you upload one, your profile picture.
  • When you participate in a campaign, we may publish your display name on that campaign's page.

If you do not want this information published, do not provide it or do not participate in the public features of the Services.

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We use cookies and similar tracking technologies (such as web beacons and pixels, sometimes called "clear GIFs") to gather information when you interact with our Services. Some of these technologies help us maintain the security of our Services and your account, remember your preferences, monitor the effectiveness of campaigns, and understand aggregate usage. We may also use clear GIFs in emails we send to understand whether those emails are opened.

We also permit third parties and service providers to use online tracking technologies on our Services for analytics. To the extent these online tracking technologies are deemed to be a "sale" or "sharing" (which includes targeted advertising, as defined under applicable US state laws), you can opt out as described in the section "DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?" below.

You can usually set your browser to refuse cookies or to alert you when cookies are being sent. If you disable cookies, some features of the Services may not function properly.

We keep your personal information for as long as necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law. Because donations create financial records, we retain donation and transaction information as needed to meet tax, accounting, and other legal requirements, even after an account is closed.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if that is not possible (for example, because it is stored in backup archives), we will securely store it and isolate it from further processing until deletion is possible.

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. 9. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and applications include a Do-Not-Track ("DNT") feature you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is no industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

To the extent our use of analytics and similar technologies is deemed a "sale" or "sharing" under applicable state law, you may opt out as described in this section.

Your Rights

You have rights under certain US state data protection laws. These rights are not absolute, and in certain cases we may decline your request as permitted by law. These rights include:

1. What information do we collect?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide when you register for an account, make or receive a donation, create or manage a campaign, upload content, post comments, or otherwise contact us. The personal information we collect may include:

  • names and display names
  • email addresses
  • usernames and passwords
  • profile photos and images you upload
  • mailing address (when required for a campaign or receipt)
  • the content of comments and posts you submit

Payment information. When you make a donation, your payment card details are collected and processed directly by our payment processor, Stripe. We do not store full payment card numbers. We receive limited transaction information from Stripe, such as the donation amount, the card brand and last four digits, and the name and email associated with the payment, which we use to record and manage the donation.

All personal information you provide must be true, complete, and accurate, and you must notify us of any changes.

Information automatically collected

In Short: Some information, such as your IP address and browser and device characteristics, is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity but may include device and usage information such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, pages viewed and the order viewed, time spent on pages, and other technical information. This is primarily needed to maintain the security and operation of our Services and for internal analytics and reporting.

  • Log and Usage Data. Service-related, diagnostic, usage, and performance information our servers automatically collect, recorded in log files. This may include your IP address, device information, browser type, and information about your activity in the Services (such as date/time stamps, pages and files viewed, and actions taken).
  • Device Data. Information about the computer, phone, tablet, or other device you use to access the Services, which may include IP address, device identifiers, browser type, hardware model, internet service provider, operating system, and configuration information.

2. How do we process your information?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal information for the following reasons, depending on how you interact with our Services:

  • To facilitate account creation and authentication and otherwise manage user accounts, so you can create and log in to your account and keep it in working order.
  • To process and manage donations and campaigns. We process your information to handle donations, pledges, refunds, payouts, and the operation of fundraising campaigns through the Services.
  • To respond to inquiries and offer support. We process your information to respond to your inquiries and resolve any issues with the Services.
  • To send administrative information, such as details about our products and services, changes to our terms and policies, and other similar information.
  • To enable user-to-user interactions, such as displaying donor and organizer activity on public campaign pages where applicable.
  • To request feedback about your use of our Services.
  • To improve the Services, including by storing, tracking, and analyzing usage, preferences, and trends in order to develop new features and improve design and performance.
  • To market and promote our Services. We may identify the schools, teams, and groups that use the Services as customers, and we may use fundraising campaign content and information that you have already made public through the Services, such as campaign titles and descriptions, team and group names, photos displayed on a public campaign page, the amount raised, and the number of supporters, to promote and market our Services. We do not use your private information or contact details (such as your email address) for this purpose. For clarity, we do not use any content from the FanAngel Connect Service or student data to market our Services; those are governed by the FanAngel Connect Privacy Policy and your school's data privacy agreement.
  • To comply with our legal obligations, respond to legal requests, and exercise, establish, or defend our legal rights.

3. When and with whom do we share your personal information?

In Short: We may share information in the specific situations described in this section and with the following parties.

  • Payment processor (Stripe). We share the information necessary to process your donation with Stripe. Stripe's handling of your information is governed by its own privacy policy.
  • Campaign organizers. When you pledge or donate to a campaign, we share your name and email with the administrator of that campaign so they can manage and acknowledge contributions. Email addresses of people who do not donate or pledge to a campaign are not shared with that campaign's administrator.
  • Campaign beneficiaries. When requested by the campaign administrator, we may share the display names and emails of donors with that campaign's beneficiary.
  • FanAngel Foundation. Where a donation is made to or through the FanAngel Foundation, we share the donor's name, email, and donation amount with the Foundation so it can issue the applicable tax receipt and acknowledge the gift.
  • Service providers. We share information with third-party vendors and service providers that perform services for us, pursuant to a written contract, such as hosting, analytics, and email delivery.
  • Legal and safety. We may disclose information where we believe in good faith it is appropriate or necessary to enforce our terms, respond to a subpoena or legal request, protect the security or integrity of our Services, or protect the rights, property, or safety of FanAngel, our users, or others.
  • Business transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

We do not sell the names or emails entered into the Services, and we do not lease or give them to third parties except as described in this Privacy Notice.

4. Public campaign pages and profiles

In Short: Some information you provide is published on public campaign pages.

FanAngel Fundraising is a public fundraising platform. Please note that any content you post, such as your display name, profile photo, and comments, is not treated as private and may be published on the Services. Specifically:

  • We may publish a profile page that includes your display name and, if you upload one, your profile picture.
  • When you participate in a campaign, we may publish your display name on that campaign's page.

If you do not want this information published, do not provide it or do not participate in the public features of the Services.

5. Do we use cookies and other tracking technologies?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We use cookies and similar tracking technologies (such as web beacons and pixels, sometimes called "clear GIFs") to gather information when you interact with our Services. Some of these technologies help us maintain the security of our Services and your account, remember your preferences, monitor the effectiveness of campaigns, and understand aggregate usage. We may also use clear GIFs in emails we send to understand whether those emails are opened.

We also permit third parties and service providers to use online tracking technologies on our Services for analytics. To the extent these online tracking technologies are deemed to be a "sale" or "sharing" (which includes targeted advertising, as defined under applicable US state laws), you can opt out as described in the section "Do United States residents have specific privacy rights?" below.

You can usually set your browser to refuse cookies or to alert you when cookies are being sent. If you disable cookies, some features of the Services may not function properly.

Google Analytics

We may share your information with Google Analytics to track and analyze use of the Services. To opt out of being tracked by Google Analytics, visit https://tools.google.com/dlpage/gaoptout. For more information on Google's privacy practices, see the Google Privacy & Terms page.

6. How long do we keep your information?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We keep your personal information for as long as necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law. Because donations create financial records, we retain donation and transaction information as needed to meet tax, accounting, and other legal requirements, even after an account is closed.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if that is not possible (for example, because it is stored in backup archives), we will securely store it and isolate it from further processing until deletion is possible.

7. How do we keep your information safe?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

8. What are your privacy rights?

In Short: You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

Withdrawing your consent. If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time by contacting us using the details in the section "How can you contact us about this notice?" below. This will not affect the lawfulness of processing before withdrawal or processing conducted in reliance on lawful grounds other than consent.

Account Information. If you would like to review or change the information in your account or terminate your account, you can log in to your account settings and update your account. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information to prevent fraud, troubleshoot problems, assist with investigations, enforce our legal terms, and comply with applicable legal requirements (including financial recordkeeping for donations).

9. Controls for do-not-track features

Most web browsers and some mobile operating systems and applications include a Do-Not-Track ("DNT") feature you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is no industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

10. Do United States residents have specific privacy rights?

In Short: If you are a resident of California, Virginia, Colorado, Connecticut, or Utah, you may have specific rights regarding access to and use of your personal information.

We may use your personal information for our own business purposes, such as undertaking internal research for technological development and demonstration. This is not considered "selling" of your personal information.

We have not sold or shared personal information to third parties for a business or commercial purpose in the preceding twelve (12) months, other than the disclosures to campaign organizers, beneficiaries, the FanAngel Foundation, and service providers described in this Privacy Notice. To the extent our use of analytics and similar technologies is deemed a "sale" or "sharing" under applicable state law, you may opt out as described in this section.

Your Rights

You have rights under certain US state data protection laws. These rights are not absolute, and in certain cases we may decline your request as permitted by law. These rights include:

  • Right to know whether or not we are processing your personal data
  • Right to access your personal data
  • Right to correct inaccuracies in your personal data
  • Right to request deletion of your personal data
  • Right to obtain a copy of the personal data you previously shared with us
  • Right to non-discrimination for exercising your rights
  • Right to opt out of the processing of your personal data for targeted advertising, the sale of personal data, or profiling that produces legal or similarly significant effects

Depending on the state where you live, you may also have the right to obtain a list of categories of third parties to which we have disclosed personal data, the right to obtain a list of third parties to which we have sold personal data, the right to question and correct how personal data has been profiled, and the right to limit the use and disclosure of sensitive personal data, each as permitted by applicable law.

How to Exercise Your Rights

To exercise these rights, you can contact us by submitting a data subject access request, by emailing us at info@fanangel.com, or by referring to the contact details at the bottom of this document.

Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof of valid authorization to act on your behalf.

Request Verification

Upon receiving your request, we will need to verify your identity to confirm you are the same person about whom we have information. We will only use personal information provided in your request to verify your identity or authority to make the request. If we cannot verify your identity from the information we maintain, we may request additional information for the purposes of verification and for security or fraud prevention. If you submit a request through an authorized agent, the agent will need to provide written, signed permission from you.

Appeals

If we decline to take action regarding your request, you may appeal our decision by emailing us at info@fanangel.com. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons. If your appeal is denied, you may submit a complaint to your state attorney general.

California "Shine The Light" Law

California Civil Code Section 1798.83, the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. To make such a request, please use the contact details in the section "How can you contact us about this notice?"

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.
